The 49th Legislature, 1st Regular Session adjourned Sine Die, 7:31am July 1. The General Effective Date is September 30, 2009. The 49th Legislature, 3rd Special Session adjourned Sine Die, 1:43pm August 25, 2009. The General Effective Date is November 24, 2009.
Information About New State Land Department Funding Mechanism
The Arizona 49th Legislature passed HB 2014 in its 3rd Special Session which allows the Department, as the Trustee for all State Trust lands, to fund its management of State Trust land off of a percentage of revenue derived from the permanent disposition of State Trust land or assets. Now Arizona is similar to most other states with Trust land, including New Mexico who shares our enabling act, who retain a small portion of the Trust's revenue for operating expenses. This measure was signed by the Governor on August 21, 2009.
During the 2nd Regular Session, the Arizona 49th Legislature passed SB 1195 which allows the Department to retain the administrative fees it collects. Previously, these fees were deposited into the State General Fund and then appropriated to the Land Department. While the funds are still appropriated, the changes made through SB 1195 eliminate the possibility that more fee revenue is deposited into the General Fund than is appropriated from the General Fund for Trust related expenditures. This measure was signed by the Governor on May 6, 2010.
